L1 to H1 and L2 to H2 transfer

HI,
I am looking to get my L1 (Company A) to H1 with COS (Company B) transfer and my wife who is on l2 visa is looking to get transferred to H1 too. I want to join H1 B company in April 2010 and till then I want to continue working on L1. Is it Legal
I talked to my employer and his lawyer and they said that if I send them a letter saying that my current project is critical and I need to be there for another 3 months this should be fine. Is this correct.
If my wife goes back to India in Jan 2010 and comes bacc in Feb 2010 can she still come on L2 or not. please explain

There is no such provision.

To be on L1 you need to do leapfrog. Search for it on this forum.
