  • H1B Stamping

    Hi everyone!

I got my H1B approved last month and i am planning to go to India (New Delhi) in dec/jan to get the stamping. I graduated with a masters in the US in december and been working on this project since april. I have heard these rumors about people getting rejections when they go for stamping. Can anyone please let me know how true these rumors are. I have all the relevant documents, client letter etc. Would it be hard for me to get the stamping done?
Any help on this matter would be appreciated.

    Thanks.

As long as you have all the required documents and if they are genuine, you have nothing to worry about.

I should have mentioned it in my previous post, i work for a desi consulting company. It is not a small company though & have around 40-50 consultants on its payroll. Some are on bench but most are on projects. Would that be an issue?

Not sure what "bench" means to this company. Do they pay a consultant who is in bench? Do you know of any recent successful visa stamp for a consultant from this company? If yes, then most likely their company documents are good.

Attending a visa interview for a desi consulting company is not a reason to worry, as long as you have a valid project.

No, they don't pay to people on bench. They had a few people who went to India for stamping and most of them got through just fine. There are some cases though which got stuck there. I was wondering if that is just an individual case rather than something fishy about the company. I have strong credentials with a masters from a top university. It's just that because of this economy i had to join these guys and now i am scared as to what is going to happen if i do go there for stamping.

When you work for a company on H1B you need to get paid irrespective of whether you are on a project or not. Not paying on bench is illegal. It is hard to comment without knowing the credibility of the company. Since you are already in a project and you know of people who got their visa's stamped successfully through this company, your chances are good. Your pay stubs and client letter will support you.

It is advisable to go to your home country when you do a first time h1b stamping. Otherwise you need to be prepared to stay in the country of stamping for more days than expected. I know of someone who recently got stuck in Canada for almost a month due to administrative processing. Luckily he got the approval to work from there.

So in effect, it doesn't really matter which country you go to? I would prefer going to India anyway. Someone told me it is easier to get it done in canada/mexico, that is why i asked. Not sure how true/false that is.

                  Thanks.
