  • RFE on H1B Extension to submit the client letter

    Hello ,
Greetings !! My name is Raj , this email is regarding query for H1 B Extension Petition . I was working for a client through vendors in Florida . At July 17th my H1 visa validity ended and my employer filed for H1 extension on July 16th . The Florida project ended on Aug 28th . I got the RFE on Sept 28th that needs to be responded by Oct 31st ; asking for Client letter , Client location, phone number and name of the person I was reporting to . They also asked for my job responsibilities ,title, duration of the project , my supervisor etc .

In the meanwhile I got a new project on Sept 14th in WA state with new client and LCA for the new project is filed on Oct 9th . I heard that the LCA takes 2 weeks for Approval .
My concern is how do I answer this query as , my old project has come to end . I can't get the client letter from the Old client( they don't encourage any communications for contractors ) , but I can provide the client letter for the recent client .

1.Do I need to provide the old client details and tell them that project is done and I am working on new project by providing all the supported documentation (new client and vendor) ?
2.Withdraw the Original petition and apply for a new petition with new client and vendor details . Is this possible , and if we go for the option 2 what would be my status in between ?

Please reply to this post .

    Thanks,
    Raj

Your lawyer should tell you the best option. #1 seems sensible. #2 is not possible as your status already expired and no further extension will be approved if you follow #2.
