  • OPT to H1B

    Hello,

    I need some information regarding OPT to H1B. I have my OPT valid till Jan 2010. My H1 approved for FY 2009. My questions are.
    1.Is the conversion from OPT to H1B is automatic ? or do we need to apply for change of status..?
    2. If the conversion is automatic.. can i go back to OPT and use OPT till it is expired and then use H1 after OPT.
    3. How many months can I be in status without payroll from the start date of H1B.

    --if you have received I797 A (attached I-94) then your current status is H1B.

    2. If the conversion is automatic.. can i go back to OPT and use OPT till it is expired and then use H1 after OPT.

    --Search for a term leapfrog on this forum.

    3. How many months can I be in status without payroll from the start date of H1B.

      To my understanding i can't go back and stay on OPT till it's expiry and then use h1b. Correct me if i'm wrng.

        I don't think leapfrog works for OPT/F1 situations as the sevis online record is terminated upon the COS to H1b. One cannot revert back to student status after the sevis record is terminated unless the DSO does specifically request the sevis record to be reinstated in certain circumstances only.
