If you are not currently in status, a COS is not possible. You should have done it as soon as you lost your status.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

--You have already lost your job then how is it possible?

--If you are not working or not getting paid on H1B that means you are out of status.
--In your case you are out of status since last 2 months.
--Employer didnt cancel your H1B does not mean you are in status.

As txh1b mentioned any COS wont be approved as you are not maintaining your status on H1B.

As employer has not cancelled the H1b, they still are responsible to pay you. Complain to DOL about them not paying you. They must pay you at all times, project or not. That is the law.
