  • paycheck doubt for txh1b

    txh1b,

i was getting close to (i dontmind telling my sal) 63k on my opt.now its been 1 year since i joine dthis co. and i would get ~67.9 k on my h1b.but h1b is filed with 68k.and i will be having only 1 paycheck on h1b when i go for stamping.that will show 67.9/12/2 that is for a bi-week from 1st - 15th.would it be a problem in stamping.please let me know.

    thx.

Your employer must pay the minimum mentioned in the LCA. Any lower amount is a violation of the DOL rules. Though it may not be an issue for H1b stamping due to the fact it is 100 dollars lower, you need to sort it out with your employer.

      thx txh1b,

i can talk to my employer i dont think that should be a problem.but heres my thing.all along i was paid 63k/12/2 for every week and on h1 in particular its 68k.will this be a problem with the VO?

does VO really care how much i got in F1 OPT stem extn. the fact is first we agreed on 60k in the offer leter last year in F1 OPT but i got paid hourly for 4-5 months but after than in recession i took a sal cut and got paid annually because client liked my work.i was fine with it because i like the wokr i do. something related to my field and non-IT.

should i take additional letter from my employer as to why i was paid hourly then paid annually and now with my contract further extended a pay increase not a huge diff, but substantial to not be overlooked..please let me know. WILL IT PLEASE the VO?
