  • H1 Extension with previous L1 stay

    I have a question on H1B extension.

I previously worked on L1 status between 2003 and 2007 for a period of 37 months (after removing the gaps between my visits to India).

In 2006 I applied for H1B and got the approval in Jan 2007. But I did not switch to H1B immediately and continued to work in L1 until May 2007.

I went back to India end of May 2007 and came back to US on H1 in Jan 2008 and I was granted the visa and I-94 till Sep 2009.

So, we filed for H1B extension in May 2009. I was not aware of L1 term being counted and due to mis-communication my attorney was not aware of my L1 stay. So, he filed for 3-yr extension and my application got approved. Now I have the approval till Sep 2012.

In the recent discussions with my friends I found that L1 term is generally counted during H1B extension and in which case I should get the approval till Sep 2010 only.

I am planning to visit India for few weeks on vacation and since my previous visa is expired I have to go for visa stamping in India.

My fear is that, will my visa application be denied because of my previous stay on L1 though I have the extension approval?

    Pls. help me in this.
