I am not sure how to say my case is H4 extension or H4 transfer.

H4 Visa getting expired on Jan 2010 (B Company)So moving to different companies H4 (thats is A company) for extension.

1.What are the documents required H4 extension or transfer
2.What is the fee for h4 Extension/transfer
3.How many days it will take to get approve? Can H4 can stay If H4 extension process going even their Visa date got over?.

What do you mean by moving to a different company? What is H4 extension have to do with changing companies?

For H4 extension, you need the primary H1B holder's I-797, two months of pay stubs of the primary h1b applicant, clear passport copies of biographic and visa pages of H4 holder, marriage certificate and copy of unexpired I-94 of H4 holder. See form I-539 for more details.

I think it is $300. Check the USCIS web site for the updated information.


3.How many days it will take to get approve?
It depends on the processing center. Usually it is 60 - 90 days.


Can H4 can stay If H4 extension process going even their Visa date got over?.
Yes, you can stay after filing the H4 extension. If your H4 extension is denied for some reason and if your I-94 has already expired, then date on which the I-94 expired to the date until when you are in U.S is termed as illegal stay.


4.what is the process to apply H4.
For H4 extension of stay, you need to file form I-539 based on the primary applicant's extended H1B petition.
