My H-1b 6 year period expires in March 31, 2011. I am currently working with Company A who has filed my Perm last month (Nov 09). I am looking to move to Company B to be in the same city as my spouse.
I have got a verbal offer from a hiring manager in Company B but because of current hiring situation, their legal firm has told the manager that they will not apply for PERM for the next 6 months.
When company B applies for my PERM after 6 months, it will be too late to qualify for 7th year extension. So my question is will Company B be able to make use of the PERM filed by Company A to apply for my 7th year H1B extension?
I request your advice / input to help solve this problem. If there are any other solutions, please do let me know too.
