Correction on Visa Stamping

Hi experts,

This is Pavan

I have a H1B petition until September 2010 but when was issues a visa 2 years back , it was given as Visa Expiration date: Feb 14th 2010.

I am going to indian on a trip and coming back to USA on Jan 24th. So i have a valied visa of less than 1 month , even though i have a valied H1B of 9 more months.

Would there be a problem when i entering US at the port of entry in Chicago?

There should not be any problem at the POE since your visa is still valid when you re-enter. Usually they will give you the extended I-94 until the petition validity. But there are also chances that the officer @ the POE can issue you an I-94 just till the visa expiry date. In which case you will have to file for the extension of stay immediately.

1) i did not understand by what you meant "file for the extension of stay immediately"

2) Is it the Visa stamping thing ?how do i do this?where should i be doign this.?

>>>> Extension of stay on H1B means extending your H1B petition beyond your current H1B I-94 validity. Your employer need to do that. So talk to them.

>>>> Visa is just an entry document to U.S. Once you are inside U.S, it is the I-94 that counts. You need to extend your I-94 before it expires so that you can continue to stay in U.S and work on H1B. So talk to your employer about filing an extension.
