  • H4 to H1 issues

    Hi friends,

    I got approval in oct 2008.

    But I went to India on sep 2008 and came back to US on nov 2009 on H4.

    Now I got project.

    One of my friend said that I am on H4 as I entered to US on H4. So, I have to apply for COS.

    Can anyone of you know what docuemnts should I havefor COS? IS client letter must and shood for COS?

    Please let me know

    Ohh sorry I forgot to mention in my previous post that I got H1 approval in Oct 2008

      If you already have a H1b stamped, you can travel to Canada/Mexico, enter with a new I-94 indicating H1b status. If a COS is requested, you have to wait till it gets approved to begin work.

        I heard that these days client letter is necessary for stamping as well as COS.

        This is true? without client letter we can't do COS or stamping?

          Proof is required that you have a job for any visa change of status or at the consulate.

            sir, one more question. Actually my project is in-house project. My employer didnt show my name to client so far. But I am working for them since 2 months.
            sir, Please advice me. How can I get client letter from them?

            just employer letter shoud be enough for visa stamping? please let me know.

              If it is a "REAL" in-house project, the employer has to provide proof about the customers that are going to use the product, the product documentation, requirements etc ...Anything that will substantiate the need for you on this project, how many others are on this project etc.

              Thanks to rampant fraudulent consulting companies...they are the ones everyone should thank for the scrutiny by USCIS that will weed out the shady companies for good.
