    Members,

    My Husband First H1 with company A is from oct-2006 to sep-2009.
    And my H4 is from jan-2007 to sep-2009.
    He joined company B and I got my H4 approval till Dec-2010.

    Went to India in sep 2008 and came back Nov-2008. Immigration officer while issuing I94 at port of entry entered same date as in my visa, even though i showed new approval doc, he didnt put the new date.

    Later on I found that I94 date in my passport is already expired (3 months) but in my new approval I94 dates are from jan 08 till Dec-2010

    what should i do now to resolve this issue?

    Well, as per the last action rule, the last received I-94 takes precedence over the others. So if the last I-94 that you received is at the POE while returning back, then your stay after that I-94 expiry is illegal. You should have applied for an extension before it was expired (Expiry of the approval notice doesn't matter. It is the I-94 that counts). Extension within U.S is not possible now since you are illegal. You need to go out of the country immediately, get the H4 visa stamped and return back. If you stay illegally for more than 6 months you could get up to 3 year ban and for 12 months, you could get up to 10 year ban.

        EAD renewal

        Hi,

        I applied for renewal of EAD and went for a walk-in biometrics and photo at Texas Service Center. How long will it take to get EAD card usually after this...Since this is L2 EAD, I believe there is no need for any interview.

        Can someone give any idea on this. Actually i was working and now on break till I get my card!!!

          Once you file the case, USCIS will send you a receipt with a receipt number( 13 digit) this is your case number. The approximate processing time will be indicated on the receipt. It can take few weeks to several weeks to process your case.

          The duration of receiving the EAD depends on a Service Center which has jurisdiction over where you will live. You can check and track your case status online using case/receipt number in the USCIS website Or call National Customer Service Center 1-800-375-5283

          Note: If you do not hear from USCIS within 90 days, you can go to the nearest USCIS by taking an infopass appointment and obtain an interim EAD card.
