New H1B after applying for Labor

I am L1A with an international company and have applied for Labor (PERM) through a consultant outside in October 2009. My 7 year limit on L1A will end December 2010. Can I apply for new H1B now and start working on H1B? Please advice. Thanks for the help.

After a year of PERM only, you're eligible for 1-year extn.
Else you've to spend 1 year out of US.
