non cap case

I came to understand that i am eligible for Non cap H1B visa. (I had my H1B visa and i overrided it with my current L1 ext, i was told by the attorney that i am eligible for non cap H1B. My h1B approval starts from oct 2008)

1) Do i/employer have to apply the non cap H1B before this year FY2010? or
2) how long i can have this non cap h1B eligiblity (say if i do not apply for it now). Is there any expiration date within which it should be applied and got?

You can check here. But sometimes, the information here would not be accurate, since USCIS takes their own time (sometimes) to update the correct case status.
