  • Suggestions required for H1B stamping

    Dear Seniors,

I'm planning to visit India and there is a need for stamping too. I'm working for a company from almost 2 yrs on full-time basis. Everything was going fine but in 2009 they skipped 3 paychecks because of their financial issues. Meanwhile they have reduced my salary from January. Below are my doubts..

Q1) If I'm going to stamping by end of Feb with last 4 paystubs (2 months) will that be enough or they need more. For 2009 wages can I show 2009 w2.
Q2) 2009 wages(w2) exceeds the rate of pay mentioned in my LCA document but less than the amount mentioned in my offer letter. Will it be an issue?
Q3) Being a full-time employee.. is there any need to get letter from client or my employer's letter is enough, because I directly report to my employer for the project I'm working.

    Kindly suggest me ASAP..

    >>> That depends on the VO. If the VO requests more play slips, then you should be able to provide it. Hopefully, 4 months of pay slips should be enough.

Q2) 2009 wages(w2) exceeds the rate of pay mentioned in my LCA document but less than the amount mentioned in my offer letter. Will it be an issue?
    >>> Should not be a problem as long as your gross is not less than what is mentioned in your LCA. Since this is a re-stamping, employment verification letter is more important than the offer letter.

Q3) Being a full-time employee.. is there any need to get letter from client or my employer's letter is enough, because I directly report to my employer for the project I'm working.
    >>> Client letter is very essential only if you work at the client location. However, if you can get the client letter, do carry it with you.

      Thanks for your quick response.

Do you mean Employment support letter, when you say Employment Verification Letter. I'm getting a letter from my employer which is addressing to US consulate which gives all the details of my employment, salary, title, job description. Is this enough?.

Also do I need to carry any vacation confirmation letter?.

Also the company I'm working here is a small company with revenues around $5M. Is it an issue?.

        >>> That is enough. This verifies that you are still employed with them (The H1B petitioning company).

        >>> No need for a separate letter. That can be included in the above letter.

        >>> That should not be a problem.
