  • H1 Transfer - Does Bridge situation apply to this case?

    Current Situation:

    I was on H1 with company A and got laid off on 13 th Nov 2009. Company A's H1B visa and I-94 are valid toill 05th June 2010. Company B decided to transfer H1 (A to B) and filed H1 transfer application on 12 th Dec. on Premium Processing at Vermont Service Center. I have the Receipt # on 14th Dec and started working for Company B. I got an RFE on 23rd Dec.

    During this time, I got a better offer from company C and they filed for H1 transfer from B to C on Premium Processing using the receipt # from Company B's petition on 28th Dec. at California Service Center. Company C's petition is approved with I-797B (consular processing, without I-94) on 30th Dec 2009. Attorney raised a Service Request o get I-797A with I-94 instead of I-797B.

    Company B responded to RFE on 12th Jan 2010. In the mean time, Company A withdrew their H1 on 14th Jan 2010.

    Company C's H1 is approved with I-797 A and I-94 (valid till 10th March 2012). Company B's H1 is still being processed and I am on Company B's payroll as of today (28th Jan 2010).

    Question:
    ---------
    1) Because I got I-797A approval for Company C's petition, can I start working with Company C right away?
    2) What happens to my status if Company B's petition gets rejected or if Company B decides to withdraw their petition? Will current approval for Company C's petition get voided automatically?

    Please advice.

    >>> No. You are all good since you have the approval notice from Company C.
