H1 cos

Hi,

I got my H1B approved on Oct 2007. Unfortunately i was not informed so i went back to india and entered again on L1 on Dec 2007. I came to know my approval through my consultant only when i asked him to apply for H1 for 2008 cap. Since then i`m on L1 till now. If i want to do a COS without going out of the country, can my consultant use the H1B approval i got on Oct 2007?

Yes, they use that CAP and apply for a COS to h1B.
