Visa Application Denial Advise

Dear sir/madam, we are in the u.s. On my husbands h1b visa, we filed i13o (sponsored by husbands brother,u.s citizen)november 2008. We made the mistake of filing the same form for myself and 2 children. The uscis have denied us. Should we appeal or let it be dismissed and wait the approval of my husbands i130 and then we file for i485. The uscis have not advised us what to do in this situation, we also paid the fee of $355 each.

You need to get your husband's I-130 approved first.

However, all of you can apply for I-485 only when the priority date is
current. It usually takes around 12 years from the date of filing I-130
before the priority date can be current.
