  • H4 provision in the new form DS 160

    Hi,

    The new form DS 160 is not clear in terms of the Purpose of travel for a H4(family category). If the husband is in USA and the family wants to apply for a H4 using the new DS 160, should the family mention themselves as "principal applicant" or not?. The reason for this question is "You are not the principal applicant if you are accompanying your spouse or parent who is coming to the United States in a category of visa that permits them to work, study, or get married. ".
    But in my case the family is joining me after a gap of one year wherein the existing H4 needs renewal.
    However i want to confirm the steps involved here
    DS 160 Travel Information -> "Are you the principal applicant (y/N)"

    we select "No" then enter the principal applicants Last name and First name and select the category of visa the primary person has and then mention his EAC #.
    Is this the process to be followed?

    H4 is not the principle applicant. They are termed as dependent applicants. The person who is holding the work permit (H1B, L1) is the principle applicant.

            Person travelling with you

            hi,

            In the H4 category if one of the kids is a US citizen, In DS 160 do we have to enter their details in the column "Persons travelling with you"?

              Not able to see screens in link

              Hi,

              I open this link and I can't find screen by screen description. Can you please post correct one? or please advice if I amlooking into into wrong place.

              Or let me know about the same query ( H4 is a Principal or not).

                Once you click on that link, look at the left side bar. There are links for screen by screen instructions.

                H4 is NOT principal applicant, H1 is.

                  I am also in same situation .i.e one of my kid born in USA. Do we have to give details about the kid in "Persons travelling with you" ?

                      Hi, Seems my wife already submitted the DS160 with USA born Kid details in that section. Will it be OK if we give those details also? we haven't took appointment yet. Do you suggest to modify DS 160?

                          i am applying for H4 visa. i have a question for SURNAMES of PRINCIPAL APPLICANT

                          my wifes name is e.g. anne curtis smith. this is the name that appears on her passport, US visa for h1c and on her i797. however my wife was legally adopted by her stepfather so by the time that we got married this year(2010), all the court order to change name has been released including new birth cert from national statistics office. so her new name on our MARRIAGe CONTACT is already e.g anne curtis garcia. ( garcia-is her adoptive fathers last name)

                          she got married to me so her name now is anne garcia-cortez (cortez eing my last name)


                          what should i place on the box for SURNAMES OF PRINCIPAL APPLICANT? should i place all 3 of her last names or just the one on her passport,visa and i797(smith)?

                            Keep whatever is there in passport and go with all supliment documents and don't post same question in multiple threads.

                              sorry about that and thanx alot for ur feedback.

                              the box at the ds160 form is asking for SURNAMES of PRINCIPAL APPLICANT.. should i write down all 3? or just the one on my wife's visa and passport?


                              i already have all the supplemental docs like marriage cert and my wife's court order and birth certificates. my concern is what to fill up in the box
