H4 - H1 question on Consular processing

Hi, Im currently on H4 and would like to file for H1 this April. my employer has agreed to do the filing.

My attorney now says, my application will be sent for Consular processing.

I have my masters degree also from here in US but in science background and have an evaluation performed for my experience giving me an equivalent undergrad degree in IT.

Question:
Can anyone tell me why will it be a Consular processing and not a Change of Status?
Am I eligible to apply and qualify for the H1 in masters quota.
