Lets say that I have been working under H-1B status in a position that requires a Master's Degree, and the company wants to sponsor me to apply for Permanent Residence through employment (EB-2 classification).
In order to agree with the DOL's Permanent Labor Certification requirements..
do the company have to open a recruitment process for my position even though I already have it?
or do they have to offer me a different job in order to start a recruitment process on that position?
