  • H1B Grace Period

    Hello Fellows,

My current H1B Visa is set to expire on May 1, 2019 and unfortunately I recently got laid off by my employer as part of massive company wide layoff. My concern is do I qualify for 60 day grace period or not. Technically I'm still on paper employed by my company till May 21st but they no longer are filing my H1B extension. How much time do I have? Thank you very much

You remain in status until 60 days after you stopped working, or when your I-94 expires, whichever is first. So if your I-94 expires on May 1, you cannot stay longer than that, unless a Change of Status or Extension of Status is filed before that.

This is my personal opinion and is not to be construed as legal advice.
