passport expiry will have any effect on duration on extention given?

what if passport expiring in aug 2011 and applying h1 ext in July 2010. in this case can I get 3 yrs of extention?
or extention only till the passport expiry date?

Hi sree,

H1 extension i.e. I-797 does not depend on the Passport expiry.

it mainly depends on the following:

(a)It is given on the basis of how much you have utilized your 6 year term on
(H1+L1)- if green card is not filed
(b)If Green card is filed - then what all steps/phases are approved
(c) if in any Client project- then what is the duration of that project.

You need to worry about passport expiry only when you go for visa stamping.
