H1 Denied - Question H4 EAD concurrent process

Hi,

240 days were completed on my H1B decision and i went on LOP on May 11th. I received a denial on May 21st and i am planning to travel back to India. My spouse has an approved I-140 and therefore, i would like to resume work on H4 EAD.
Can i apply for H4 and EAD in parallel even though i do not have a valid I-94 at this point?

Please let me know the available options.
