Hi, need the help in filing h4 ead
I entered last time to usa in March on h4 (with my spouse old employer) as visa validity is there till October 2019 and also receive the i94 as per the same.
my spouse changed his employer in January and received the h1b-i797 approval in March and get the validity of 3years . So he applied my h4 with new employer in May , however we didn’t receive the notice yet.
recently my spouse i40 is approved so we are planning to apply for EAD but there are few questions in this filing
1) if we use my current i94 (which is valid only till oct 20-9 and the passport has visa with old employer) and my spouse current i797 (which has validity of 3years) , can I expect the H4 ead validity which matches my spouse i797
or will it be based on my current i94 .
2) for better purpose, can I go out of country and and get new h4 stamped then apply h4 ead to get the validity of 3years
please suggest me the correct options. Thank in advance
