h1 transfer and return with old h4

Hello forum gurus,

pls suggest... My wife is in india and now i am opting for a H1 transfer as i got a FT opportunity. My wife got H4 stamped when i was with my old employer. can she travel to US now without going to consulate again as her visa is valid till sep 2010. does she has to go to consulate for stamping with my new H1? I appreciate any suggestion.

Let me explain my situation so that you can help me as per your experience.

My wife had her H4 visa stamped in Feb based on my old H1 and she never entered USA.
Now i joined another company for FT and they initiated my H1 transfer.
Now I am planning to bring my wife in June.
Can she travel with old H4 visa to USA?

H4 is not tied to a company. H4 is based on your valid H1B status. So she can travel using the existing visa. However, she will get an I-94 only till the old petition validity. If she wants an I-94 matching your extended petition, then she will have to wait for your extension/transfer to get approved.
