H1B visa refused - petition still valid !!!!!

Hi,

I got my H1b extension approved for 3 years. Came to India for my marriage and stamping and unfortunately my Visa got refused even though I got all my documents in place ( client letter , W-2 etc )

My Client is ready to give a client letter for me if I have to apply a new H1.

I have 2 questions:

1. Should I apply for brand new H1B ?

2 .Will my petition still be valid , so that my client in US can take this petetion and file a H1B for me ?

You can transfer the petition to the client and upon approval, you can attend the visa interview again with the documents from your new employer (Who is your client now). As long as the reason for the visa rejection is not you, your chances of applying again and getting it stamped is good.
