  • H1B premium process transfer issue,previous employer canceled H1B & notified USCIS

Thank you for your replies. There are very helpful.

My attorney told that I got H1B approval without I-94 and I had been referred to US consular process in India/home country for H-1B stamping at Chennai, India. I am going to leave this week-end to Chennai to get the stamping.

If you have initiated the transfer process before the previous employer sent a letter for revoking the H1B, then the transfer should have gone through without any issues. You have mentioned that you received the approval notice by mail. Then what is the problem? Are you saying that the approval notice came with a new I-94 (meaning, consular process)? If so, then why don't you get the new petition stamped and re-enter?

It is not advisable to go with opetion 4 in your post. B1 is not a work visa and it is illegal to do so. COS to B1 and llater back to H1B will have impacts later.
Not a legal advice. Use of this information is strictly at your own risk.
