I am currenly in the US on an L1B visa. My five years will be up in Aug 2010. I am planning to apply for an L1B to H1B transfer. I also have an approved H1 petition from 2005. This H1 was never used or stamped. According to my company I can apply for the L1B to H1 transfer under the quota exempt category since I have a previously approved H1 petition.
The issue is that my company is saying that this L1B to H1 conversion can only be done when I am physically in my home country. i.e. I cannot apply for this conversion while I am here in the US. Can anyone please confirm whether this is accurate. Is this a USCIC rule?
