  • H1B petitin approved..changing employer...urgent!!

    I am currently on OPT and have got my H1B approved for a start date of Oct 1, 2010. Now if I change my employer before Oct 1, I understand that my new employer B would need to file a new I-129 petition for me. In order to get exempted from cap I understand that I need to attach the I-797 approval notice from employer A along with the petition by employer B to prove that I am already quota counted. Here I have a question:

    Since I do not have the original receipt and have only SCANNED COPY of the approval notice, can I just take the printout of that scanned copy and attach it with my new petition or I need to attach the original I-797 approval notice sent by USCIS?

    Please clarify.

    As far as I know, you dont need to present the original, cuz in my case, they only asked for photocopies.

        All that is required to prove that you are already CAP counted, is the receipt number from the approval notice. A copy of the approval notice will help to make sure that the receipt number entered belongs to you.
