  • H1B transfer related

    Hello all,
I am going to transfer my H1B. My question is, can employer apply for H1B transfer now with a start date of a project that is 4 months from now? is there a time limit?

    Thanks, i appreciate your help.

Yes. Employer can start. But the chances are like - you may get transferred h1 with only 4months extension. Again after 4months you need to file extension. And in positive side, if you are lucky, you may get another 3yrs or whatever time left in your total stay of 6yrs - with the new employer.

      Thanks for the reply.
but i did not understand one thing. Suppose employer is applying on may 1st based upon an ongoing project and the project start date they are showing to USCIS is Sep 1st, so that means the employer is asking USCIS to give work permit to a H1B employee to work from Sep 1st onwards for their company in that project.
So how can USCIS be ended up giving workpermit from May1st to Aug end i.e. for 4 months?

Did you mean this or something else?

      Thanks,

In that case, it should be fine. I thought that the employer is filing it for 4months project from the current month. But as you mentioned h1 transfer, if you are in US, then during upto Sep01, you need to be working with either new or old employer.
