H1b transfer when present in India

Hi,
I got fresh H1B approval from Oct-2009 to Sep-2012 by transfering from L1 . I traveled India(home country) on Feb'2010 and got visa refusal(221g) stating the reason as

"Your petitioner does not appear to be either able or willing to provide qualifying employment in the United States in accordance with appropriate laws and regulations"

Could you please clarify that,
"Since petitioner is found to be having some issues but not with my profile, Can I TRANSFER my H1 to a New Employer as currently I am present in India"??
or
there is only the way to enter into US is, file a fresh h1 in this year(2010-2011) cap??

You can transfer it to a different employer. Upon approval, you can try and get the H1B stamped with the documents from the new employer.
