My wife is expecting and her due is in next couple of weeks, but my H1 extension is denied and my H1 visa and I94 are already expired. Now, due to time constrain, we have no way other than to give birth to child in USA even though our visa is denied. After child birth, will our child be given US citizenship still? If so, when we apply for US birth certificate and US passport for my child, will they ask for any of our non-immigrant status documents (like I797 or I94 or valid visa etc.,)? Best part is, I have US driving license valid until 2024, but my wife's driving license is expired. Please provide your thoughts.

This post is related to my previous post. My H1 Extension is denied and my I94 was already expired. Since I have Canada work permit visa, I will move to Canada from US. My mother-in-law is currently staying with us in US under B2 visa (Visitor) and she did not reach 180 days mark in US still. We are planning to take her to Canada under Canada Visitor visa which she needs to apply yet. Note, she got her B2 US visa (visitor) based on my sponsorship few years back. Now if she wants to apply Canada Visitor visa from US, is it possible with me as sponsor because I have valid Canada visa, even though I am already in unlawful status in US now? If it is still possible, few forms which need to be filled, where it asks for Sponsor's Canada address. I am cornered now. Does anybody experienced this or have any thoughts on this?
