Severance pay overlap with regular pay

If the person on H1B visa is laid-off and got a job in an another company before the last day, Can he wait until the last day in present company and take the severance package before joining the future company. If the severance amount will be paid bi-weekly for 2 months from the last day, can he get 2 paychecks (a severance pay check from old company and a normal pay check from future company) if he is on H1-B visa. Kindly advice.

Severance pay check should not be a problem. You just cannot work for both the companies at the same time and get actual pay slips, unless the 2nd H1B is processed as a concurrent H1B.
