H1 in the edge of 6 years - Labor/I140 options

  • H1 in the edge of 6 years - Labor/I140 options

    Hi All,

    I have another 6months of H1 valid then completing my 6 years term. My labor processing is going very slow. I just completed the prevailing wage and posting job advertisements sometime next week or so. Looking at the things I may not get I140 approved before 6months. Given this would it be possible, I take a break right NOW by converting to H4 once labor/I140 got approved re-initiate my H1-B status. Technically is it possible? Please let me know any cons with this approach.

    Please suggest, if I have any better options other than the above.

    I appreciate all your inputs on this one.

    Yes, you can move to H4 now, and file for an extension of H1 & switch back after your I140 is approved.
