My wife's H1-B extension is under premium processing (Her Visa is expired last month) and my get result in few days.If the extension is accepted no issues. If the H1-B extension is rejected, as per policy she need to travel to country of origin.
But as you know, due to Coronavirus, it is extremely dangerous to travel. I would like to know, how can we avoid/postpone her travel in this case?
Is there any immigration law which supports this scenario? Can we file her COS (H1 to H4 as my dependent) after the rejection?
Is there a legal way that we can approach, to stop their travel in this case due Pandemic? Can we file a case for the awareness of this issue to USCIS?
Please help, This is urgent.
Thanks,
Kumar
