Regarding extension

Hi
By next year my 6 year period in US is going to expire. I have applied for labor but it went to audit. If I don't get my Labor
Can I change my status to F1 and extend my stay in US with out going back to India. If not what other options I have to extend my stay in US?

If you have applied for the labor 365 days before the end of the 6th year period, then you can extend the H1B for 1 more year based on the pending labor. If not, then you need to apply for a different status. Even if you change your status to F1 now, to get back to H1B, you need to spend one year outside U.S.
