  • H1 stay after expiry

    Hi,

I am in H1 and still have three more year to complete 6 years. inbetween I have applied for H1 extension since it is going to expire Aug 28, 2010 which is being processed. In case of any delay or the process will still go even after my expiry date (ofcourse i have still 3 more years under H1), what about the stay in USA or can i work in the same company . if so , how long it is?

    Thanks
    CoolGuy

Stay beyond I-94 expiry date will not cause any issues provided your extension gets approved. If the extension gets denied, then your stay beyond the I-94 expiry date will be considered illegal. That is why it is advisable to file for extension at least 3-4 months in advance.
