Valid H1B and student Visa for MS

I am in India and my H1-b visa and petition both will expire in September 2020. I want to apply for MS in US for Fall 2021. I never worked in the USA on this visa. My employer is planning to apply for petition extension before it expires.

Should I refuse my employer for petition extension given my study plan?

Can I get Student Visa if I also have H1-b approved petition?

Please guide me.

They are two different classes of visa and your passport may have both H1 & F1 stickers.
But having a recently stamped H1 visa followed by an F1 will trigger questions from the Visa Officer on your intent of coming to the US.
So if your plan is to study, then just apply for an F1

Thanks for the answer. Should I let my employer apply for petition extension in that case or let it expire? If my H1-b petition and visa both are expires when I apply for F1 then I am on safer side, correct?
