  • 221 (g) white form @ Mumbai

    I recently attended visa interview @ Mumbai consulate and got 221 (g) white form - need to submit following documents. Thought of sharing with you all for reference. Will share result and time taken once I submit documents.

    1) A copy of the petition with all supporting documents as filed to USCIS (including full I-129, cover letter for USCIS, and educational equivalent report)
    2) Petitioner’s Income Tax Return for the last two tax years and financial statements.
    3) A notarized list of all the petitioner’s employees. The list should show employees’ names, their specific job titles, starts and end dates, their individual salaries, their immigration status, and which project/client they are working with.
    4) State Unemployment Wage Reports, showing all wages paid to each employee in the state, to the past three quarters as filed to: All States (This should be the actual forms filed to the State authorities listing each employee and wages paid during the quarter)
    5) A letter (on letterhead) from the personnel department at the U.S. job site stating that there is a vacancy for you.
    Or
    A letter from the client company sponsoring the project and a copy of the contract between the U.S.-based petitioner and the client company, stating the timing, terms and agreement for your project.
    Or
    A detailed and specific description of the internal development project to which you will be assigned. Include a complete technical description of the project , employer, timeline, current status, number of employees assigned, worksite location, and marketing analysis for the final project.

    Unfortunately my employer could not arrange the client letter till now and I have no choice to wait for few more months.

    Now, my question is that will it be counted as visa rejection if I fail to submit required documents within one year (date is mentioned in the 221g form)? If yes then how can I withdraw my application? Do I need to personally go and submit withdraw application or just an email would suffice (not too sure if email would be accepted)?

      Receiving a 221g is considered as rejection unless the 221g gets cleared later. Withdrawing the petition is not going to clear that record.

      If you would like to withdraw the petition, you can write a letter to the consulate and they will send your passport back and stop any further processing.

        Thanks Shervin! They did not take my passport - last question, so does that mean whenever (if I fail to submit documents before due date) I file any new visa (any country) next time I need to mention this as a visa rejection?
