    Unused H1

    Hi

    Currently I am on L1 from company A and I have unused H1 Petition is valid since Oct 2008 from company B .If I do change of status L1 to H1 with another employer C whether I can claim the unused years which is 1.7 years since the petiton approved.

    L1 + H1B in total is for 6 years. Subtracting the time spent on L1, you will get the remaining period when you switch to H1B.

      Time spent in the US in L1 or H1 status counts against 6 years. Status is determined by I-94 issued at POE or attached to COS/EOS approval.
