    Hi everyone,

    I have just got word that my H1B transfer has been approved, yet to receive the I-797 in hand.

    Q1. Is it advisable to visit India for a month (a) before I join (after getting the new I-797 in hand) where I will need to go for visa stamping (came here on an F1) or (b) join the new company and then take off to India right away or (c) delay my India trip by a few months?

    Q2. Will I have to produce paystubs of old company at US consulate in India if I go right now? (I have not worked for last 4 weeks since I applied for H1B transfer, so can only produce up to June 14th).

    You are out of status from June 14th which can be an issue when you attend the visa interview. You need the latest pay slips for the visa interview. You may end up with 221g. Advisable to travel later.

    When you are in H1B status, you need to have pay slips for all the months. Being out of status can be an issue later (visa stamping, GC etc) as your W2 won't match your LCA.
