H4 to H1,If H1 denied ...?

Thanks in advance for your help.

I have a basic question but friends are giving different answers.

I am on H4.Some company is proposing H4 to H1 transfer .If H1 denied, Will I illegal to stay on H4 in U.S?Will it be problem to go again for H1 in the future?If H1 approved no worries any how...

Hello,

If the the H1 is denied, you should be legal as long as the your H4 status remains valid.

H4 to H1 is CoS (not transfer).
if denied, you will continue to be in old status until old I-94 expiry date.
No issues with new H1 etc.
