H1B extension

Hi,

My H1B visa is getting expired and also max out on July'21. my PERM is in progress and it was filed on Nov'20. I have 3 months on my h1 to recapture.my question is can I able to file extension based on the recapture period, if in case I140 approval is not received before maxout?.

Hi,
Yes.. you can recapture the days that you were not in the USA.. With that, you can able to extend your H1B.. If you get your I-140 Approval at the time of Ext, then you are eligible for 3 yrs of Approval. But, Please note, Approval durations are based on the documents...
