  • Remote work, H1-B and GC

    Hi all,

I am on H-1B (my wife is on H-4) and want to know if I can work remotely in another state. What do my employer need to do? And can they sponsor me for GC even though I'm not working for them physically?

    Thanks.

---- Any employer can sponsor you for a GC. You can work part time for another employer provided tehy apply for part time H1. Do you mean work from home when you say remotely---this may be possible occassionally but I am of the firm opinion that it cannot be a regular feature

Thanks Subramanya. Yes, when I said "remotely" I meant to work from home in another state. I am currently working full time (physically) in Hawaii for this company and want to move to Nevada and continue working full time for this company remotely.

      So my specific questions are:
      • Do I need to change my H-1B?
      • Can my employer sponsor GC for me even though I work (for them) in another state?

I want to know the possibility before I could bring this up to my manager.

      Thanks.

        Hi,

I've revised my question into a scenario below:

Let's say I am on H-1B and my current employer files green card petition for me. Then with the employer's permission, I move to another state and work remotely for this same employer.

        My questions:
        1. Is it possible to move to another state while waiting for green card?
        2. Will moving to another state breaks the petition?

        Thanks.

GC is for future employment. Your current work location has nothing to do with the GC process.
