Hi Guys,
My wife is working on a H1B in US. I am currently working in India and I have travel before on H1B once and had to comeback due to rejection of Extension petition (there is still 5 years left on my H1b), I want to travel to US on H4 and try to find a sponsor who can transfer my Visa from H4 to H1.
I am planning to travel to US on a H4 visa by taking LOP from my company .
As the notice period in my company is a bit long i.e 3 months , In case I find a sponsor in US which will transfer my H4 to H1b , would i be able to work during the notice period in the new company? As I can only put resignation once my visa is transferred , new firm may not be able to wait for entire 3 months .
Do I require some sort of NOC from my current company before i can start work in the new company in US ?
Let me know Any such scenarios if anyone has come across before would be helpful.
