H1-b Petition date and Legal Status

Hi all,

My OPT has expired on this June 15th, 2010. And, I knew that I had 60-day grace period after the expiration of my OPT. So, I have submitted a new application for a master's degree to my school in this July, but it's still pending for approval.

The grace period is over now. And, my employer will be filing my H1B application to USCIS next week. Do I have to concern about any legal status in this period? If I do, what is your advice?

You must consult with your school's DSO to determine if your SEVIS is active. Did you receive a new I-20 for the new program and start studying in that program?
