  • Moving to new company, new i140 required?

    Hello All

    Greetings for the day and hope everyone is safe.

    I have my I140 approved with my old company A.

    Right now, I am working with company B from one year as I got 3 yr H1B extension using company A I140.

    Company B is asking they will start their I140, but I don't want to as I want to move out of this company.

    So my question is as I have 1 and half year left on my H1B with company B, can I not have my I140 process start with company B, move to a new company and

    will this new company be able to apply for my H1B using company A I140?

    Please let me know.

    Hi,
    If you are not willing to process GC from your current Employer then you can deny the GC Employment from them. It is not compulsory that, your current Employer should file GC to you again. If you already hold I-140 Approval with your previous Employer, With the help of Approved I-140, you can extend your H1B with any Employer.. And if you prefer to initiate GC from your New Employer, Yes you can do so.
