  • H1B Extension Due & Travelling now...

    Hi,

    I have opened another thread with the sub:"H1B Extension - Urgent help needed" in continuation to that following is my current situation:

    My consultant(Collabera) is placing me onto a project on coming Tuesday and asking me to come to US immediately as i am still in india. My H1B Visa expires on 28Sept 2010. They have given EVL(Employment Verification Letter) which they say will be good enough at Port Of Entry.

    Next thing is, my visa extension they say it can done as soon as i land in US. Not sure what would be the diffculty here esp. considering my visa expires soon.

    I am leaving my very good job here in India and coming out there to look for good future.

    Would be of great help if you can give answers in this matter.

      Hi Shervin & Others,

      I have a project with one reputed client as they liked my profile.

      My question are,

      1. Is it safe to travel when the H1B Visa about to expire in 1 month(sept 28 2010) assuming the EVL letter takes and other documents probably answers all questions as per my consultant.

      2. Would there by any serious consideration for the H1B extension when applied only few days advance. for H1B extension, is pay stubs mandatory?

        >>> Yes. When exactly is your approval notice expiring? You might get the I-94 only till the expiry date of the I-94. Sometime the officer at the POE may decide to give you an I-94 only till the expiry date of the visa. In such case, you will have to file the extension of stay immediately after reach U.S.

        2. Would there by any serious consideration for the H1B extension when applied only few days advance.
        >>> No. However it is advisable to apply at least 3-4 months prior to the status expiry. If your extension is rejected for any reason, then the time spent after the I-94 expiry date will be considered illegal which may cause issues later. In such case, its advisable to ask your employer to file the extension in premium.

        for H1B extension, is pay stubs mandatory?
        >>> Yes, just for the duration you were in H1B status in U.S. Usually latest 4-5 months will do if you have been in H1B status for a long time.

          My visa expires on 28 sept 2010. I plan to travel to US on 24th Aug 2010.
          I hope H1B extension is not a problem.

            You have just 1 months to file the extension. Extension by normal process will take 2-3 months. If rejected after 2-3 months, you would have accumulated illagal stay. So ask your employer to file the extension in premium to be in a safer side.
