Revoked H1 petition and visitor visa

Hi Awesome people,

I have two questions. I applied for H1 visa in 2014 with employer X and got the petition approved. I also got the visa stamped along with my spouse but never travelled. One year later, I left the company and the employer revoked my petition.

1. Can I apply under H1 cap exempt if an employer likes to offer me a job?
2. For this summer, I would like to apply to visitor visa to travel to US with my spouse for tourist purposes. Can I apply for tourist visa without impacting my chances of H1 in future?

1. Can I apply under H1 cap exempt if an employer likes to offer me a job?
Answer: I dont think you will be eligible for H1B CAP exempt. In order to obtain H1B status again, you will need to again consider H1B CAP filing.
2. For this summer, I would like to apply to visitor visa to travel to US with my spouse for tourist purposes. Can I apply for tourist visa without impacting my chances of H1 in future?
Answer: Yes. You can apply for Visitors visa, as long as your purpose of travel to the USA is short term and there is no immigrant intent. And your B visa stamping will not impact for considering H1B filing.
